Terms of Service
These Terms of Service (“Terms”) govern your access to and use of WindowIQ, including its mobile applications, desktop applications, websites, cloud services, and related features (collectively, the “Service”). The Service is provided by windowiq.co (“WindowIQ,” “we,” “us,” or “our”).
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be legally capable of entering into a binding agreement under the laws applicable to you. If you use WindowIQ on behalf of a business or organization, you represent that you have authority to bind that organization to these Terms.
WindowIQ is intended primarily for professional and business use in the window, door, construction, fabrication, measurement, design, sales, quotation, and related industries.
2. Accounts and Sign-In
WindowIQ may allow sign-in through third-party identity providers such as Google or Apple, and may also offer limited use without an account (“Guest Mode”).
Your WindowIQ account is separate from your Google, Apple, or other third-party account. Third-party identity providers authenticate your identity, while your WindowIQ account, projects, subscriptions, cloud data, and related Service data are managed by WindowIQ.
You are responsible for maintaining control of the devices and third-party accounts used to access WindowIQ. Notify us promptly if you believe your account has been accessed without authorization.
WindowIQ may support linking multiple authentication methods to one account. We may require email verification, reauthentication, or another proof of account ownership before linking identities.
3. Guest Mode
Some features may be available without signing in. Guest Mode may have limitations, including cloud backup, synchronization, collaboration, recovery, or cross-device access.
Guest Mode data may be stored only on the device unless the Service expressly indicates otherwise. Removing the app, clearing app data, losing the device, or changing devices may result in loss of Guest Mode data.
If you later sign in, WindowIQ may offer a way to associate eligible local Guest Mode data with your account.
4. The Service
WindowIQ may provide tools for measuring, drawing, designing, visualizing, organizing, quoting, sharing, and managing window- and door-related projects. Features may vary by country, platform, device, plan, application version, or business arrangement.
We may add, modify, suspend, or discontinue features from time to time.
5. Professional Responsibility and Measurement Accuracy
WindowIQ is a productivity and design-assistance tool. It is not a substitute for professional engineering, architectural, structural, safety, fabrication, installation, legal, tax, or regulatory advice.
Measurements, drawings, 3D visualizations, quantities, quotations, calculations, generated documents, and other outputs may contain errors or depend on information entered by the user.
You are responsible for independently verifying dimensions, specifications, pricing, quantities, structural requirements, installation conditions, building-code requirements, and other project information before ordering, manufacturing, fabrication, construction, installation, or contractual commitment.
You must not rely on WindowIQ as the sole basis for a decision where an inaccurate measurement, calculation, quotation, or design could cause property damage, financial loss, injury, or violation of law.
6. Your Content
“User Content” means information and materials you upload, create, enter, store, or transmit through the Service, including project information, measurements, drawings, designs, photographs, customer information, notes, quotations, and documents.
You retain ownership of your User Content.
You grant WindowIQ a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, transmit, display, and otherwise use User Content only as reasonably necessary to provide, maintain, secure, improve, and support the Service and as described in our Privacy Policy.
You represent that you have the rights and permissions necessary to provide User Content to the Service, including personal information relating to customers, employees, contractors, or other individuals.
7. Acceptable Use
You may not use the Service to violate law or third-party rights; upload malware; attempt unauthorized access; circumvent security; reverse engineer except where law expressly permits; scrape or resell the Service without authorization; impersonate others; create fraudulent or infringing materials; or disrupt the Service.
We may investigate suspected violations and may restrict or terminate access where reasonably necessary.
8. Intellectual Property
Except for User Content, the Service and associated software, interfaces, graphics, trademarks, logos, documentation, designs, and other materials are owned by or licensed to WindowIQ and protected by applicable intellectual-property laws.
Subject to these Terms, WindowIQ grants you a limited, revocable, non-exclusive, non-transferable right to use the Service for its intended purposes.
9. Paid Services, Subscriptions, and Purchases
WindowIQ may offer paid features, subscriptions, licenses, upgrades, or other purchases. Prices, billing periods, included features, renewal terms, cancellation rules, taxes, and refund conditions will be disclosed at or before purchase.
Purchases made through Apple App Store, Google Play, Microsoft Store, or another marketplace may also be subject to that marketplace’s payment, renewal, cancellation, and refund rules.
10. Third-Party Services
The Service may interact with third-party services, including authentication providers, app stores, payment providers, cloud infrastructure providers, analytics providers, email providers, or other services. Your use of those services may be subject to separate terms and privacy policies.
11. Privacy
Our collection and use of personal information are described in the WindowIQ Privacy Policy.
12. Account Suspension, Termination, and Deletion
You may stop using WindowIQ at any time. Where account deletion is available, you may request deletion through the applicable in-app process or by contacting us by email.
We may suspend or terminate access if we reasonably believe you violated these Terms, created a security risk, used the Service unlawfully, failed to pay applicable fees, or materially harmed the Service or other users.
13. Service Availability
We aim to provide a reliable Service but do not guarantee uninterrupted or error-free operation. The Service may be unavailable because of maintenance, network conditions, third-party outages, defects, security incidents, or circumstances outside our reasonable control.
You are responsible for maintaining appropriate backups of important business records and project information.
14. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WINDOWIQ DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND RELIABILITY.
Nothing in these Terms excludes rights or warranties that cannot lawfully be excluded.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WINDOWIQ AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, OR BUSINESS OPPORTUNITY ARISING FROM OR RELATING TO THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WINDOWIQ’S TOTAL LIABILITY ARISING FROM OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO WINDOWIQ DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD 100.
These limitations do not apply where prohibited by applicable law.
16. Indemnification
To the extent permitted by law, if you use WindowIQ on behalf of a business, you agree to indemnify and hold harmless WindowIQ and its affiliates from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful use of the Service, your User Content, or your material violation of these Terms.
17. Changes
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice through the Service, website, email, or another appropriate method where required.
18. Governing Law and Disputes
These Terms are governed by the laws of the People’s Republic of China, without regard to conflict-of-law principles, except where mandatory local law provides otherwise.
Disputes that cannot be resolved informally will be submitted to the competent courts at the place where we are established, unless applicable law requires otherwise.
19. General
If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and any applicable product-specific terms, constitute the agreement between you and WindowIQ concerning the Service.
